General Terms and Conditions (GTC) for the holiday apartments and flats of Wasserburg Anstel
This English version is provided for convenience. In case of doubt, the German version (“Allgemeine Geschäftsbedingungen”) prevails.
§ 1 Scope and contracting parties
1. These GTC apply to all contracts for the rental of holiday apartments and furnished flats between Wilfried and Ursula Jochemich, Wasserburgstraße 30, 41569 Rommerskirchen, Germany (the “Landlord”) and the guest (the “Tenant”).
2. Deviating terms of the Tenant do not become part of the contract unless the Landlord expressly agrees to them in text form.
§ 2 Conclusion of contract
1. The Tenant’s booking is a binding offer. The contract is concluded upon the Landlord’s booking confirmation, which may be given by e-mail, in writing or verbally.
2. Upon conclusion of the contract the Tenant undertakes to pay the agreed rental price.
§ 3 Prices and payment
1. The total price shown in the booking system includes final cleaning. Charges for additional guests are shown separately.
2. Unless otherwise agreed, the rental price is payable in full no later than 14 days before arrival. For short-notice bookings the amount is due immediately.
3. If payment is not made despite a reminder and a reasonable grace period, the Landlord may withdraw from the contract; § 6 applies accordingly.
§ 4 No right of withdrawal
For contracts for accommodation on a specific date there is no statutory right of withdrawal pursuant to § 312g (2) no. 9 of the German Civil Code (BGB). The cancellation terms in § 6 apply exclusively.
§ 5 Arrival and departure
1. The apartment is available to the Tenant from 4:00 pm on the day of arrival.
2. On the day of departure the apartment must be vacated in proper condition by 9:00 am at the latest.
3. Different arrival or departure times are possible by prior arrangement.
§ 6 Withdrawal and cancellation
1. The Tenant may withdraw from the contract at any time. Cancellation must be made in text form (e-mail is sufficient); receipt by the Landlord is decisive.
2. The following cancellation rates apply:
- up to 30 days before arrival: free of charge
- 29 to 14 days before arrival: 50 % of the rental price
- less than 14 days before arrival or no-show: 100 % of the rental price
3. The Landlord will credit saved expenses and income from renting the apartment to another party. The Tenant may prove that the Landlord has suffered no loss or a substantially lower loss.
4. The Tenant may provide a substitute tenant who takes over the booking on the existing terms. The Landlord may object if the substitute is evidently unsuitable.
5. The Landlord reserves the right to withdraw for good cause, in particular in the event of force majeure or if the apartment becomes uninhabitable. Payments already made will be refunded without delay in such cases.
§ 7 House rules
1. Smoking is prohibited in all apartments; smoking is permitted only in the designated outdoor areas.
2. Pets are not permitted.
3. Quiet hours from 10:00 pm to 7:00 am must be observed.
4. The apartment must be kept clean during the stay; waste must be separated.
5. The apartment may only be used by the agreed number of persons. Subletting or transfer to third parties is not permitted.
§ 8 Obligations and liability of the Tenant
1. The Tenant is liable for damage to the rented property culpably caused by the Tenant, fellow travellers or visitors.
2. Damage must be reported to the Landlord without delay.
§ 9 Liability of the Landlord
1. The Landlord is liable without limitation for intent and gross negligence and for injury to life, body or health.
2. In the event of slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical of the contract at the time of conclusion.
3. Otherwise liability is excluded. Liability under the German Product Liability Act and for breach of a guarantee remains unaffected.
4. For disruptions or failures beyond the Landlord’s control (e.g. power cuts, internet outages, natural events) the Landlord is liable only within the scope of the preceding paragraphs.
§ 10 Registration requirement
Pursuant to §§ 29, 30 of the German Federal Registration Act (Bundesmeldegesetz), foreign guests are required to complete a registration form and to present an identity document on request. Registration forms are kept for one year and then destroyed.
§ 11 Data protection
The Landlord processes personal data in accordance with the privacy policy available on this website.
§ 12 Final provisions
1. German law applies. Mandatory consumer protection provisions of the state in which the Tenant is habitually resident remain unaffected.
2. The place of jurisdiction at the Landlord’s registered office is agreed only if the Tenant is a merchant, a legal entity under public law or a special fund under public law, or relocates their residence outside Germany after conclusion of the contract.
3. The Landlord is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
4. Should individual provisions be or become invalid, the validity of the remaining provisions remains unaffected.
